This policy for the protection of personal data applies to job applicants for job vacancies announced by SimRa Consulting Eastern Europe EOOD /abbreviated as the Agency.

The current policies describe:

The policies, rules and procedures for the protection of personal data are in accordance with the legal framework /CPDP, Ordinance N1 of the CPDP of January 30, 2013 on the minimum level of technical and organizational measures and the permissible type of personal data protection, Regulation (EU) 2016/ 679 of the European Parliament and of the Council of April 27, 2016, Ordinance on the terms and conditions for carrying out employment mediation activities /from September 29, 2017/.

  •  Purpose of collecting personal data

The purpose of collecting personal data is the execution of a contract for the performance of a recruitment service for a specific position for an employer company.

The data below is aspirational. Job applicants decide for themselves what data to provide.

  • Name and surname
  • Phone and/or email
  • Residence - city
  • Information about education, additional qualifications and training, acquired skills
  • Information about work experience - name of employer, position held, duration, duties and responsibilities
  • Information you provide about your career development preferences
  • Information you provide for current and/or desired compensation
  • Information you provide in connection with referrals
  • Document from police services when it concerns the employment of a foreign person for work in the territory of the EU or when it concerns the employment of Bulgarian citizens abroad

Personal data that job applicants must provide when conducting an interview at the Agency.

In connection with the Ordinance on the terms and conditions for carrying out employment mediation activities /from September 29, 2017/, the Agency is obliged to sign mediation contracts with all candidates who have passed a job interview with a specific employer. Intermediation contracts require you to provide personal data for:

  • Name and surname
  • EGN
  • Number of personal ID
  • Residence - full address
  • Personal signature

In the event that a candidate refuses to sign a mediation contract, the Agency has no right to process, store and send his documents for consideration by the employing company. In this sense, the candidate cannot continue his participation in the competition and his documents should be deleted.

We use the information described above to perform the following activities:

  • Contact you to organize a meeting with a representative of the Agency and a representative of the employer company
  • Determining whether the applicant's professional experience and qualifications match the requirements for the position he is applying for by conducting a face-to-face interview, telephone interview, online interview or social media interview
  • Sending job vacancies related to your qualifications, experience, expectations
  • Response to inquiries from individuals;
  • Defend against, identify and prevent fraud and other illegal activities, claims and other liabilities 
  • Compliance with and enforcement of applicable legal requirements, industry standard and contractual obligations and our policies.

The Agency collects personal data through:

  • Agency careers website
  • Documents sent to the Agency's personal account on specialized sites/online platforms offering services for publishing job advertisements and enabling job seekers to apply online
  • Documents sent to company e-mail in connection with a published job advertisement on the Agency's website, social networks, etc. suitable online platforms, newspapers, etc.
  • Reach passive job candidates through social media through targeted messaging

IMPORTANT: The Agency is not responsible for security breaches on sites and platforms of third-party providers through which applicants submit their job applications.

  • Processing of personal data

Personal data from resumes are processed only by authorized persons - consultants - recruitment agents who are in employment with the Agency. Personal data is not made available for consideration by third parties, not even the employing company, without the express consent of a candidate and if the candidate has not been interviewed beforehand. Personal data is treated by employees as confidential.

  • Provision of personal data to third parties

The Agency undertakes not to disclose any information about job applicants without their express written consent, except where we are required to do so by law, if we are formally requested to do so by a government/regulatory body or where disclosure meets legal requirements, is related to the prevention/detection of crime and/or protects the public interest.

Your personal data will be provided to:

  • The employer company - The data from the resumes are provided to employers only after the express written consent of the candidates for one and/or more jobs. With each employer, the Agency signs an agreement/annex, according to which the company is obliged to process and store your data in accordance with the requirements of the current legislation - the GDPR, regulation N1 of the GDPR and REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 (General Data Protection Regulation), has no right to distribute and provide them to third parties without your consent and should delete them after the purpose of their collection has been completed.
  • The employer company has the right to request and receive from a job candidate an online extract from the digital record of the employment file in order to certify the actual time served as a specialist in a certain field of business activities.

IMPORTANT: The agency is not responsible for security breaches and/or non-compliance with the PPE on the part of the employer company. In the event of a security breach, the company is obliged to notify all interested parties. If you have doubts and/or are convinced that the processing is contrary to the regulations, notify us immediately and/or submit an objection to the employer.

  • State institutions: Employment Agency, Main Labor Inspectorate, CPLD as state and control bodies - data from mediation contracts and declarations are provided, in accordance with legal requirements.

  • CVs are stored until the end of the purpose of their collection and the termination of the Agency's commitments in the performance of the contract for the selection of personnel concluded with the employer company
  • The purpose of collecting resumes is considered completed after the appointment of a candidate recommended by the Agency to the relevant position and successful completion of his probationary period or after the signing of a protocol between the Agency and the employing company to terminate the performance of the contract.
  • This term is 6 months from the month of submission of the documents and in accordance with the term of the mediation agreement, but not more than 3 years.
  • The term can be extended only after requested consent from the candidate, and when it is necessary to update resume data
  • Brokerage contracts / registration form and declarations of consent

Mediation contracts and declarations are kept for the legally required period of 5 years.

  • Delete personal data

All documents / resumes, mediation contracts, declarations / on paper and electronic media, including documents in the Agency's accounts on specialized sites/on-line platforms are deleted/destroyed after the expiration of the established storage period.

  • Rights of job applicants
  • Right to withdraw their consent - the applicant has the right to withdraw their consent at any time and terminate their participation in the competition. The desire to withdraw consent must be demonstrable and expressed in writing.
  • When the applicant has expressed a desire to delete personal data, the Agency immediately deletes all documents containing his/her personal data.
  • The right to lodge a complaint with the national regulator - Commission for the Protection of Personal Data
  • Right to rectification – the applicant has the right to supplement, correct the personal data provided by him. It is the applicant's commitment to provide the Agency with any changes in personal data that he wishes to have corrected.
  • Right to deletion / the right "to be forgotten"/ - the applicant has the right at any time to wish to have the personal data provided by him deleted. This does not apply to documents containing personal data that are required by other laws to be kept for a certain period of time. This request must be provable and expressed in writing.

We maintain and implement administrative, technical and physical safeguards to protect the personal data you provide against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use.

  • Updating the policy on protection of personal data

The present policies may be periodically updated in connection with legal changes and/or changes in the practices of the Agency under the ZLD. Last update: 19/03/2024.
